Abu Sa’eed Al-Khudri narrated that The Messenger of Allah said: “It is not lawful for a woman who believers in Allah and the Last Day to travel on a trip that is three days or more, unless she is accompanied by her father, her brother, her husband, her son, or someone who is a Mahram to her.”

حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ، حَدَّثَنَا أَبُو مُعَاوِيَةَ، عَنْ الْأَعْمَشِ، عَنْ أَبِي صَالِحٍ، عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ، قَالَ:‏‏‏‏ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ لَا يَحِلُّ لِامْرَأَةٍ تُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ، ‏‏‏‏‏‏أَنْ تُسَافِرَ سَفَرًا يَكُونُ ثَلَاثَةَ أَيَّامٍ فَصَاعِدًا إِلَّا وَمَعَهَا أَبُوهَا، ‏‏‏‏‏‏أَوْ أَخُوهَا، ‏‏‏‏‏‏أَوْ زَوْجُهَا، ‏‏‏‏‏‏أَوِ ابْنُهَا، ‏‏‏‏‏‏أَوْ ذُو مَحْرَمٍ مِنْهَا . وَفِي الْبَاب:‏‏‏‏ عَنْ أَبِي هُرَيْرَةَ، ‏‏‏‏‏‏وَابْنِ عَبَّاسٍ، ‏‏‏‏‏‏وَابْنِ عُمَرَ. قَالَ أَبُو عِيسَى:‏‏‏‏ هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ، ‏‏‏‏‏‏وَرُوِي عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ قَالَ:‏‏‏‏ لَا تُسَافِرُ الْمَرْأَةُ مَسِيرَةَ يَوْمٍ وَلَيْلَةٍ إِلَّا مَعَ ذِي مَحْرَمٍ ، ‏‏‏‏‏‏وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ، ‏‏‏‏‏‏يَكْرَهُونَ لِلْمَرْأَةِ أَنْ تُسَافِرَ إِلَّا مَعَ ذِي مَحْرَمٍ وَاخْتَلَفَ أَهْلُ الْعِلْمِ فِي الْمَرْأَةِ، ‏‏‏‏‏‏إِذَا كَانَتْ مُوسِرَةً، ‏‏‏‏‏‏وَلَمْ يَكُنْ لَهَا مَحْرَمٌ هَلْ تَحُجُّ ؟، ‏‏‏‏‏‏فَقَالَ:‏‏‏‏ بَعْضُ أَهْلِ الْعِلْمِ لَا يَجِبُ عَلَيْهَا الْحَجُّ، ‏‏‏‏‏‏لِأَنَّ الْمَحْرَمَ مِنَ السَّبِيلِ لِقَوْلِ اللَّهِ عَزَّ وَجَلَّ:‏‏‏‏ مَنِ اسْتَطَاعَ إِلَيْهِ سَبِيلا سورة آل عمران آية 97، ‏‏‏‏‏‏فَقَالُوا:‏‏‏‏ إِذَا لَمْ يَكُنْ لَهَا مَحْرَمٌ، ‏‏‏‏‏‏فَلَا تَسْتَطِيعُ إِلَيْهِ سَبِيلًا، ‏‏‏‏‏‏وَهُوَ قَوْلُ:‏‏‏‏ سُفْيَانَ الثَّوْرِيِّ، ‏‏‏‏‏‏وَأَهْلِ الْكُوفَةِ، ‏‏‏‏‏‏وقَالَ بَعْضُ أَهْلِ الْعِلْمِ:‏‏‏‏ إِذَا كَانَ الطَّرِيقُ آمِنًا فَإِنَّهَا تَخْرُجُ مَعَ النَّاسِ فِي الْحَجِّ، ‏‏‏‏‏‏وَهُوَ قَوْلُ:‏‏‏‏ مَالِكٍ، ‏‏‏‏‏‏وَالشَّافِعِيِّ.

ابو سعید خدری رضی الله عنہ کہتے ہیں کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”کسی عورت کے لیے جو اللہ اور یوم آخرت پر ایمان رکھتی ہو، حلال نہیں کہ وہ تین دن ۱؎ یا اس سے زائد کا سفر کرے اور اس کے ساتھ اس کا باپ یا اس کا بھائی یا اس کا شوہر یا اس کا بیٹا یا اس کا کوئی محرم نہ ہو“ ۲؎۔ امام ترمذی کہتے ہیں: ۱- یہ حدیث حسن صحیح ہے، ۲- اس باب میں ابوہریرہ، ابن عباس اور ابن عمر رضی الله عنہم سے بھی احادیث آئی ہیں، ۳- نبی اکرم صلی اللہ علیہ وسلم سے یہ بھی مروی ہے کہ آپ نے فرمایا: ”عورت ایک دن اور ایک رات کی مسافت کا سفر کسی محرم کے بغیر نہ کرے۔ اہل علم کا اسی پر عمل ہے، وہ عورت کے لیے درست نہیں سمجھتے کہ محرم کے بغیر سفر کرے۔ اہل علم کا اس عورت کے بارے میں اختلاف ہے کہ جو حج کی استطاعت رکھتی ہو لیکن اس کا کوئی محرم نہ ہو تو وہ حج کرے یا نہیں؟ بعض اہل علم کہتے ہیں: اس پر حج نہیں ہے، اس لیے کہ محرم بھی اللہ تعالیٰ کے ارشاد «من استطاع إليه سبيلا» میں استطاعت سبیل میں داخل ہے۔ وہ کہتے ہیں کہ جب اس کا کوئی محرم نہ ہو تو وہ استطاعت سبیل نہیں رکھتی۔ یہ سفیان ثوری اور اہل کوفہ کا قول ہے۔ اور بعض اہل علم کہتے ہیں کہ جب راستہ مامون ہو، تو وہ لوگوں کے ساتھ حج میں جا سکتی ہے۔ یہی مالک اور شافعی کا بھی قول ہے۔

Abu Hurairah narrated that The Messenger of Allah said: “A woman is not to travel the distance of a day and a night unless she is accompanied by someone who is a Mahram.”

Uqbah bin Amir narrated that The Messenger of Allah said: “Beware of entering upon women.” So a man from the Ansar said: ‘”O Messenger of Allah! What do you think about Hamu? So he said: “The Hamu is death.”

Jabir narrated that The Prophet said: “Do not enter upon Al-Mughibar (the women whose husband are absent), for indeed the Shaitan flows through one of you as the blood flows.” We said: “And you?” He said: “And me, but Allah helped me over him, so I am safe.”

Yunus bin Jubair said: I asked Ibn Umar about a man who divorced his wife while she was menstruating. So he said: 'Don't you know Abdullah bin Umar?' Indeed he divorced his wife while she was menstruating, so Umar asked the Prophet about that, and he ordered him to take her back.' He said: I said: And that divorce is counted? He said: And that divorce is counted? He said: 'What else would you think if he was helpless and foolish?'
