Narrated 'Ikrimah: That 'Ali burnt some people who apostasized from Islam. This news reached Ibn 'Abbas, so he said: If it were me I would have killed them according to the statement of Messenger of Allah (ﷺ). The Messenger of Allah (ﷺ) said: 'Whoever changes his religion then kill him.' And I would not have burned them because the Messenger of Allah (ﷺ) said: 'Do not punish with the punishment of Allah.' So this reached 'Ali, and he said: Ibn 'Abbas has told the truth.

حَدَّثَنَا أَحْمَدُ بْنُ عَبْدَةَ الضَّبِّيُّ الْبَصْرِيُّ،‏‏‏‏ حَدَّثَنَا عَبْدُ الْوَهَّابِ الثَّقَفِيُّ،‏‏‏‏ حَدَّثَنَا أَيُّوبُ،‏‏‏‏ عَنْ عِكْرِمَةَ،‏‏‏‏ أَنَّ عَلِيًّا حَرَّقَ قَوْمًا ارْتَدُّوا عَنِ الْإِسْلَامِ،‏‏‏‏ فَبَلَغَ ذَلِكَ ابْنَ عَبَّاسٍ،‏‏‏‏ فَقَالَ:‏‏‏‏ لَوْ كُنْتُ أَنَا لَقَتَلْتُهُمْ،‏‏‏‏ لِقَوْلِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ مَنْ بَدَّلَ دِينَهُ فَاقْتُلُوهُ ،‏‏‏‏ وَلَمْ أَكُنْ لِأُحَرِّقَهُمْ،‏‏‏‏ لِقَوْلِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ لَا تُعَذِّبُوا بِعَذَابِ اللَّهِ ،‏‏‏‏ فَبَلَغَ ذَلِكَ عَلِيًّا،‏‏‏‏ فَقَالَ:‏‏‏‏ صَدَقَ ابْنُ عَبَّاسٍ،‏‏‏‏ قَالَ أَبُو عِيسَى:‏‏‏‏ هَذَا حَدِيثٌ صَحِيحٌ حَسَنٌ،‏‏‏‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ فِي الْمُرْتَدِّ،‏‏‏‏ وَاخْتَلَفُوا فِي الْمَرْأَةِ إِذَا ارْتَدَّتْ عَنِ الْإِسْلَامِ،‏‏‏‏ فَقَالَتْ طَائِفَةٌ مِنْ أَهْلِ الْعِلْمِ:‏‏‏‏ تُقْتَلُ،‏‏‏‏ وَهُوَ قَوْلُ الْأَوْزَاعِيِّ،‏‏‏‏ وَأَحْمَدَ،‏‏‏‏ وَإِسْحَاق،‏‏‏‏ وَقَالَتْ طَائِفَةٌ مِنْهُمْ:‏‏‏‏ تُحْبَسُ،‏‏‏‏ وَلَا تُقْتَلُ،‏‏‏‏ وَهُوَ قَوْلُ سُفْيَانَ الثَّوْرِيِّ،‏‏‏‏ وَغَيْرِهِ مِنْ أَهْلِ الْكُوفَةِ.

عکرمہ سے روایت ہے کہ علی رضی الله عنہ نے کچھ ایسے لوگوں کو زندہ جلا دیا جو اسلام سے مرتد ہو گئے تھے، جب ابن عباس رضی الله عنہما کو یہ بات معلوم ہوئی ۱؎ تو انہوں نے کہا: اگر ( علی رضی الله عنہ کی جگہ ) میں ہوتا تو انہیں قتل کرتا، کیونکہ رسول اللہ صلی اللہ علیہ وسلم کا فرمان ہے: ”جو اپنے دین ( اسلام ) کو بدل ڈالے اسے قتل کرو“، اور میں انہیں جلاتا نہیں کیونکہ رسول اللہ صلی اللہ علیہ وسلم کا فرمان ہے: ”اللہ کے عذاب خاص جیسا تم لوگ عذاب نہ دو“، پھر اس بات کی خبر علی رضی الله عنہ کو ہوئی تو انہوں نے کہا: ابن عباس رضی الله عنہما نے سچ کہا ۲؎۔ امام ترمذی کہتے ہیں: ۱- یہ حدیث صحیح حسن ہے، ۲- مرتد کے سلسلے میں اہل علم کا اسی پر عمل ہے، ۳- جب عورت اسلام سے مرتد ہو جائے تو اس کے بارے میں علماء کا اختلاف ہے، اہل علم کی ایک جماعت کہتی ہے: اسے قتل کیا جائے گا، اوزاعی، احمد اور اسحاق بن راہویہ کا یہی قول ہے، ۴- اور اہل علم کی دوسری جماعت کہتی ہے: اسے قتل نہیں بلکہ قید کیا جائے گا، سفیان ثوری اور ان کے علاوہ بعض اہل کوفہ کا یہی قول ہے۔

Narrated Abu Musa: That the Prophet (ﷺ) said: Whoever carries weapons against us, he is not from us.

Narrated Jundab: That he heard the Messenger of Allah (ﷺ) saying: The punishment of the Sahir is a strike of the sword.

Narrated Umar: That the Messenger of Allah (ﷺ) said: Whomever you find stealing from the spoils of war while in the path of Allah, then burn his belongings. Salih (one of the narrators) said: I entered upon Maslamah and with him was Salim bin 'Abdullah. There was a man there who had stolen from the spoils of war, so Salim narrated this Hadith. So he ordered accordingly, and his belongings were burnt. There was a Mushaf in his belongings, so Salim said: 'Sell this and give its proceeds as charity.'

Narrated Ibn 'Abbas: That the Prophet (ﷺ) said: If a man says to another man: 'O you Jew' then beat him twenty times. If he says: 'O you effeminate' then beat him twenty times. And whoever has relations with someone that is a Mahram then kill him.

Narrated Abu Burdah bun Niyar: That the Messenger of Allah (ﷺ) said: No one is to be lashed more than ten lashes except for a legal punishment among Allah's punishments.

Narrated Abu Tha'labah Al-Khushani: I said: 'O Messenger of Allah! We are a people who hunt.' He said: 'If you send your dog and you mentioned the Name of Allah upon it, and he catches something for you, then eat it.' I said: 'Even if he kills it?' He said: 'Even if he kills it.' I said: 'We are a people who shoot (at game).' He said: 'What you catch with your bow, then eat it.' He said: Then I said:'Indeed we are a people who travel. We come across Jews, Christians, and Zoroastrians, and we do not find vessels other than theirs.' He said: 'If you do not find other than them, then wash them with water, then eat and drink from it.'
