Narrated Umar: That the Messenger of Allah (ﷺ) said: Whomever you find stealing from the spoils of war while in the path of Allah, then burn his belongings. Salih (one of the narrators) said: I entered upon Maslamah and with him was Salim bin 'Abdullah. There was a man there who had stolen from the spoils of war, so Salim narrated this Hadith. So he ordered accordingly, and his belongings were burnt. There was a Mushaf in his belongings, so Salim said: 'Sell this and give its proceeds as charity.'

حَدَّثَنَا مُحَمَّدُ بْنُ عَمْرٍو السَّوَّاقُ،‏‏‏‏ حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ،‏‏‏‏ عَنْ صَالِحِ بْنِ مُحَمَّدِ بْنِ زَائِدَةَ،‏‏‏‏ عَنْ سَالِمِ بْنِ عَبْدِ اللَّهِ،‏‏‏‏ عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ،‏‏‏‏ عَنْ عُمَرَ،‏‏‏‏ أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ:‏‏‏‏ مَنْ وَجَدْتُمُوهُ غَلَّ فِي سَبِيلِ اللَّهِ،‏‏‏‏ فَاحْرِقُوا مَتَاعَهُ ،‏‏‏‏ قَالَ صَالِحٌ:‏‏‏‏ فَدَخَلْتُ عَلَى مَسْلَمَةَ،‏‏‏‏ وَمَعَهُ سَالِمُ بْنُ عَبْدِ اللَّهِ،‏‏‏‏ فَوَجَدَ رَجُلًا قَدْ غَلَّ، ‏‏‏‏‏‏فَحَدَّثَ سَالِمٌ بِهَذَا الْحَدِيثِ،‏‏‏‏ فَأَمَرَ بِهِ فَأُحْرِقَ مَتَاعُهُ، ‏‏‏‏‏‏فَوُجِدَ فِي مَتَاعِهِ مُصْحَفٌ،‏‏‏‏ فَقَالَ سَالِمٌ:‏‏‏‏ بِعْ هَذَا وَتَصَدَّقْ بِثَمَنِهِ،‏‏‏‏ قَالَ أَبُو عِيسَى:‏‏‏‏ هَذَا الْحَدِيثُ غَرِيبٌ،‏‏‏‏ لَا نَعْرِفُهُ إِلَّا مِنْ هَذَا الْوَجْهِ،‏‏‏‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ،‏‏‏‏ وَهُوَ قَوْلُ الْأَوْزَاعِيِّ،‏‏‏‏ وَأَحْمَدَ،‏‏‏‏ وَإِسْحَاق،‏‏‏‏ قَالَ:‏‏‏‏ وَسَأَلْتُ مُحَمَّدًا عَنْ هَذَا الْحَدِيثِ،‏‏‏‏ فَقَالَ:‏‏‏‏ إِنَّمَا رَوَى هَذَا صَالِحُ بْنُ مُحَمَّدِ بْنِ زَائِدَةَ وَهُوَ:‏‏‏‏ أَبُو وَاقِدٍ اللَّيْثِيُّ،‏‏‏‏ وَهُوَ مُنْكَرُ الْحَدِيثِ،‏‏‏‏ قَالَ مُحَمَّدٌ:‏‏‏‏ وَقَدْ رُوِيَ فِي غَيْرِ حَدِيثٍ،‏‏‏‏ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي الْغَالِّ،‏‏‏‏ فَلَمْ يَأْمُرْ فِيهِ بِحَرْقِ مَتَاعِهِ،‏‏‏‏ قَالَ أَبُو عِيسَى:‏‏‏‏ هَذَا حَدِيثٌ غَرِيبٌ.

عمر رضی الله عنہ سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”جس شخص کو اللہ کی راہ میں مال ( غنیمت ) میں خیانت کرتے ہوئے پاؤ اس کا سامان جلا دو“۔ صالح کہتے ہیں: میں مسلمہ کے پاس گیا، ان کے ساتھ سالم بن عبداللہ تھے تو مسلمہ نے ایک ایسے آدمی کو پایا جس نے مال غنیمت میں خیانت کی تھی، چنانچہ سالم نے ( ان سے ) یہ حدیث بیان کی، تو مسلمہ نے حکم دیا پھر اس ( خائن ) کا سامان جلا دیا گیا اور اس کے سامان میں ایک مصحف بھی پایا گیا تو سالم نے کہا: اسے بیچ دو اور اس کی قیمت صدقہ کر دو۔ امام ترمذی کہتے ہیں: ۱- یہ حدیث غریب ہے، ہم اسے صرف اسی سند سے جانتے ہیں، ۲- میں نے محمد بن اسماعیل بخاری سے اس حدیث کے بارے میں پوچھا تو انہوں نے کہا: اسے صالح بن محمد بن زائدہ نے روایت کیا ہے، یہی ابوواقد لیثی ہے، یہ منکرالحدیث ہے، ۳- بخاری کہتے ہیں کہ مال غنیمت میں خیانت کرنے والے کے سلسلے میں نبی اکرم صلی اللہ علیہ وسلم سے دوسری احادیث بھی آئی ہیں، آپ نے ان میں اس ( خائن ) کے سامان جلانے کا حکم نہیں دیا ہے، ۴- بعض اہل علم کا اسی پر عمل ہے، اوزاعی، احمد اور اسحاق بن راہویہ کا یہی قول ہے۔

Narrated Ibn 'Abbas: That the Prophet (ﷺ) said: If a man says to another man: 'O you Jew' then beat him twenty times. If he says: 'O you effeminate' then beat him twenty times. And whoever has relations with someone that is a Mahram then kill him.

Narrated Abu Tha'labah Al-Khushani: I said: 'O Messenger of Allah! We are a people who hunt.' He said: 'If you send your dog and you mentioned the Name of Allah upon it, and he catches something for you, then eat it.' I said: 'Even if he kills it?' He said: 'Even if he kills it.' I said: 'We are a people who shoot (at game).' He said: 'What you catch with your bow, then eat it.' He said: Then I said:'Indeed we are a people who travel. We come across Jews, Christians, and Zoroastrians, and we do not find vessels other than theirs.' He said: 'If you do not find other than them, then wash them with water, then eat and drink from it.'

Narrated 'Adi bin Hatim: I said: 'O Messenger of Allah! We send our trained dogs to catch game for us.' He said: 'Eat what it catches for you.' I said: 'O Messenger of Allah, and if they kill it?' He said: 'Even if they kill it, as long as they are not accompanied by some other dogs besides them.' He said: I said: 'O Messenger of Allah! We hunt with the Mir'ad.' He said: 'Eat of the game what the Mir'ad pierces, but whatever is struck by its broad side, then do not eat it.'
