It was narrated from Salim bin 'Abdullah, bin 'Umar, from Ibn 'Umar, that : the Messenger of Allah (ﷺ) said: Whoever sells a palm tree that has been pollinated, its fruits belong to the seller, unless the purchaser stipulated a condition. And whoever buys a slave who has wealth, his wealth belongs to the seller, unless the purchaser stipulated a condition.
حَدَّثَنَا مُحَمَّدُ بْنُ رُمْحٍ، ‏‏‏‏‏‏أَنْبَأَنَا اللَّيْثُ بْنُ سَعْدٍ، ‏‏‏‏‏‏ح وحَدَّثَنَا هِشَامُ بْنُ عَمَّارٍ، ‏‏‏‏‏‏حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ جَمِيعًا، ‏‏‏‏‏‏عَنْابْنِ شِهَابٍ الزُّهْرِيِّ، ‏‏‏‏‏‏عَنْ سَالِمِ بْنِ عَبْدِ اللَّهِ بْنِ عُمَرَ، ‏‏‏‏‏‏عَنْ ابْنِ عُمَرَ، ‏‏‏‏‏‏أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ:‏‏‏‏ مَنْ بَاعَ نَخْلًا قَدْ أُبِّرَتْ، ‏‏‏‏‏‏فَثَمَرَتُهَا لِلَّذِي بَاعَهَا إِلَّا، ‏‏‏‏‏‏أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنِ ابْتَاعَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لِلَّذِي بَاعَهُ إِلَّا، ‏‏‏‏‏‏أَنْ يَشْتَرِطَ الْمُبْتَاعُ .
عبداللہ بن عمر رضی اللہ عنہما کہتے ہیں کہ   رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: جو شخص تابیر ( قلم ) کئے ہوئے کھجور کا درخت بیچے تو اس میں لگنے والا پھل بیچنے والے کا ہو گا، سوائے اس کے کہ خریدنے والا خود لینے کی شرط طے کر لے، اور جو شخص کوئی غلام بیچے اور اس غلام کے پاس مال ہو تو وہ مال اس کا ہو گا، جس نے اس کو بیچا ہے سوائے اس کے کہ خریدنے والا شرط طے کر لے کہ اسے میں لوں گا،، ۱؎۔
