It was narrated that 'Ubadah bin Samit said: The Messenger of Allah (ﷺ) ruled that the fruit of a palm tree belongs to the one who pollinated it, and that the wealth of a slave belongs to the one who sold him, unless the purchaser stipulated a condition.
حَدَّثَنَا عَبْدُ رَبِّهِ بْنُ خَالِدٍ النُّمَيْرِيُّ أَبُو الْمُغَلِّسِ، ‏‏‏‏‏‏حَدَّثَنَا الْفُضَيْلُ بْنُ سُلَيْمَانَ، ‏‏‏‏‏‏عَنْ مُوسَى بْنِ عُقْبَةَ، ‏‏‏‏‏‏حَدَّثَنِيإِسْحَاق بْنُ يَحْيَى ابْنِ الْوَلِيدِ بَنِ عُبَادَةَ بْنِ الصَّامِتِ، ‏‏‏‏‏‏عَنْ عُبَادَةَ بْنِ الصَّامِتِ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أنَّ ثَمَنَ النَّخْلِ لِمَنْ أَبَّرَهَا، ‏‏‏‏‏‏إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ، ‏‏‏‏‏‏وَأَنَّ مَالَ الْمَمْلُوكِ لِمَنْ بَاعَهُ، ‏‏‏‏‏‏إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ .
عبادہ بن صامت رضی اللہ عنہ کہتے ہیں کہ   رسول اللہ صلی اللہ علیہ وسلم نے فیصلہ کیا کہ کھجور کے درخت کا پھل اس شخص کا ہو گا جس نے اس کی تابیر ( پیوندکاری ) کی، سوائے اس کے کہ خریدنے والا خود لینے کی شرط طے کر لے، اور جس نے کوئی غلام بیچا اور اس غلام کے پاس مال ہو تو غلام کا مال اس کا ہو گا جس نے اس کو بیچا، سوائے اس کے کہ خریدنے والا شرط طے کر لے۔
