Jabir (Allah be pleased with him) reported that a woman gave her garden as a life grant to her son. He died and later on she also died and left a son behind and brothers also, The sons of the woman making life grant said (to those who had been conferred upon this 'Umra): This garden has returned to us. The sons of the one who had been given life grant said: This belonged to our father, during his lifetime and in case of his death. They took their dispute to Tariq, the freed slave of 'Uthman. He called Jabir and he gave testimony of Allah's Messenger ( صلی ‌اللہ ‌علیہ ‌وسلم ) having said: Life grant belongs to one who is conferred upon this (privilege). Tariq gave this decision and then wrote to Abd al-Malik and informed him, Jabir bearing witness to it. Abd al-Malik said: Jabir has told the truth. Then Tariq gave a decree and, as a result thereof, it is to this day that the garden belongs to descendants of one who was conferred upon the life grant.

وحَدَّثَنِي مُحَمَّدُ بْنُ رَافِعٍ، وَإِسْحَاقُ بْنُ مَنْصُورٍ، وَاللَّفْظُ لِابْنِ رَافِعٍ، قَالَا: حَدَّثَنَا عَبْدُ الرَّزَّاقِ، أَخْبَرَنَا ابْنُ جُرَيْجٍ، أَخْبَرَنِي أَبُو الزُّبَيْرِ، عَنْ جَابِرٍ، قَالَ: أَعْمَرَتِ امْرَأَةٌ بِالْمَدِينَةِ حَائِطًا لَهَا ابْنًا لَهَا، ثُمَّ تُوُفِّيَ وَتُوُفِّيَتْ بَعْدَهُ، وَتَرَكَتْ وَلَدًا وَلَهُ إِخْوَةٌ بَنُونَ لِلْمُعْمِرَةِ، فَقَالَ وَلَدُ الْمُعْمِرَةِ: رَجَعَ الْحَائِطُ إِلَيْنَا، وَقَالَ: بَنُو الْمُعْمَرِ، بَلْ كَانَ لِأَبِينَا حَيَاتَهُ وَمَوْتَهُ، فَاخْتَصَمُوا إِلَى طَارِقٍ مَوْلَى عُثْمَانَ، فَدَعَا جَابِرًا، «فَشَهِدَ عَلَى رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ بِالْعُمْرَى لِصَاحِبِهَا»، فَقَضَى بِذَلِكَ طَارِقٌ، ثُمَّ كَتَبَ إِلَى عَبْدِ الْمَلِكِ، فَأَخْبَرَهُ ذَلِكَ، وَأَخْبَرَهُ بِشَهَادَةِ جَابِرٍ، فَقَالَ عَبْدُ الْمَلِكِ: صَدَقَ جَابِرٌ، فَأَمْضَى ذَلِكَ طَارِقٌ، فَإِنَّ ذَلِكَ الْحَائِطَ لِبَنِي الْمُعْمَرِ حَتَّى الْيَوْمِ

ابن جریج نے ہمیں خبر دی ، مجھے ابوزبیر نے حضرت جابر رضی اللہ عنہ سے خبر دی ، انہوں نے کہا : مدینہ میں ایک عورت نے اپنے بیٹے کو اپنا باغ بطور عمریٰ دیا ، پھر وہ فوت ہو گیا اور اس کے بعد وہ بھی فوت ہو گئی ، اس ( لڑکے ) نے اولاد چھوڑی اور اس کے بھائی بھی تھے جو بطور عمریٰ دینے والی عورت کے بیٹے تھے ، تو بطور عمریٰ دینے والی عورت کی اولاد نے کہا : باغ ہمیں واپس مل گیا ۔ اور جسے بطور عمریٰ ہبہ کیا گیا تھا اس کے بیٹوں نے کہا : زندگی اور موت دونوں صورتوں میں وہ ہمارے باپ ہی کا ہے ۔ چنانچہ وہ حضرت عثمان کے آزاد کردہ غلام طارق کے پاس ( جو عبدالملک بن مروان کی طرف سے مدینے کا گورنر تھا ) جھگڑا لے کر گئے ، انہوں نے حضرت جابر رضی اللہ عنہ کو بلایا تو انہوں نے عمریٰ کی بابت رسول اللہ صلی اللہ علیہ وسلم ( کے فرمان ) پر گواہی دی کہ وہ اس کے ( موجودہ ) مالک کا ہے ۔ طارق نے اسی کے مطابق فیصلہ کیا ، پھر انہوں نے عبدالملک کی طرف لکھا اور انہیں اس واقعے کی اطلاع دی اور حضرت جابر رضی اللہ عنہ کی گواہی کے بارے میں بھی بتایا تو عبدالملک نے کہا : حضرت جابر رضی اللہ عنہ نے سچ کہا ، تو طارق نے اس ( حکم ) کو نافذ کر دیا ، چنانچہ وہ باغ آج تک اسی کے بیٹوں کے پاس ہے جسےبطور عمریٰ دیا گیا تھا

Sulaiman b. Yasir reported that Jabir gave this verdict. The inheritor has a right (to inherit) the life grant according to the statement of Jabir (b. 'Abdullah) (Allah be pleased with him) which he narrated from Allah's Messenger ( صلی ‌اللہ ‌علیہ ‌وسلم ).

Jabir b. 'Abdullah reported Allah's Apostle ( صلی ‌اللہ ‌علیہ ‌وسلم ) as saying: Life grant is permissible.

Ibn Umar (Allah be pleased with them) reported Allah's Messenger ( صلی ‌اللہ ‌علیہ ‌وسلم ) as saying: It is the duty of a Muslim who has something which is to be given as a bequest not to have it for two nights without having his will written down regarding it.
