Narrated Ibn 'Abbas: from Tamim Ad-Dari, regarding this Ayah: O you who believe! When death approaches any of you then take the testimony (5:106). He said: The people are innocent of it, other than myself and 'Adi bin Badda.' We were Christians who used to frequent Ash-Sham before Islam. They went to Ash-Sham for their business, and they were approached by a freed slave of Banu Sahm, who was called Budail bin Abi Maryam, with some trade. He had a bowl they wanted made of silver, but he wanted a great deal for it. Then he became ill, and willed it to them, and he commissioned them to deliver what was left to his family. Tamim said: When he died, we took that bowl and we sold it for one-thousand Dirham. Then 'Adi bin Badda and I divided it. When we went to his family to give them what was with us, they searched for the bowl and asked about it. We said: 'He did not leave behind other than this, nor did he give us other than this.' Tamim said: When I accepted Islam, after the Messenger of Allah (ﷺ) had arrived in Al-Madinah, I felt guilty about that, so I went to his family, and informed them about what had happened. I gave them fifty-thousand Dirham and told them my companion had the same. They took him to the Messenger of Allah (ﷺ) but he asked them for their proof, which they did not have, so he ordered them, to have him to take an oath in accordance with whatever the people of his religion revered, so he took the oath. Then Allah revealed: 'O you who believe! When death approaches any of you then take the testimony...' up to His saying: 'Or else they would fear that oaths will be admitted after their oaths (5:106).' So 'Amr bin Al-'As and another man stood to take an oath, and the fifty-thousand Dirham was taken from 'Adi bin Badda.'

حَدَّثَنَا الْحَسَنُ بْنُ أَحْمَدَ بْنِ أَبِي شُعَيْبٍ الْحَرَّانِيُّ، حَدَّثَنَا مُحَمَّدُ بْنُ سَلَمَةَ الْحَرَّانِيُّ، حَدَّثَنَا مُحَمَّدُ بْنُ إِسْحَاق، عَنْ أَبِي النَّضْرِ، عَنْ بَاذَانَ مَوْلَى أُمِّ هَانِئ، عَنِ ابْنِ عَبَّاسٍ، عَنْ تَمِيمٍ الدَّارِيِّ، فِي هَذِهِ الْآيَةِ يَأَيُّهَا الَّذِينَ آمَنُوا شَهَادَةُ بَيْنِكُمْ إِذَا حَضَرَ أَحَدَكُمُ الْمَوْتُ سورة المائدة آية 106، ‏‏‏‏‏‏قَالَ:‏‏‏‏ بَرِئَ مِنْهَا النَّاسُ غَيْرِي وَغَيْرَ عَدِيَّ بْنِ بَدَّاءٍ، ‏‏‏‏‏‏وَكَانَا نَصْرَانِيَّيْنِ يَخْتَلِفَانِ إِلَى الشَّامِ قَبْلَ الْإِسْلَامِ، ‏‏‏‏‏‏فَأَتَيَا الشَّامَ لِتِجَارَتِهِمَا وَقَدِمَ عَلَيْهِمَا مَوْلًى لِبَنِي سَهْمٍ، ‏‏‏‏‏‏يُقَالُ لَهُ:‏‏‏‏ بُدَيْلُ بْنُ أَبِي مَرْيَمَ بِتِجَارَةٍ، ‏‏‏‏‏‏وَمَعَهُ جَامٌ مِنْ فِضَّةٍ يُرِيدُ بِهِ الْمَلِكَ، ‏‏‏‏‏‏وَهُوَ عُظْمُ تِجَارَتِهِ، ‏‏‏‏‏‏فَمَرِضَ فَأَوْصَى إِلَيْهِمَا وَأَمَرَهُمَا أَنْ يُبَلِّغَا مَا تَرَكَ أَهْلَهُ، ‏‏‏‏‏‏قَالَ تَمِيمٌ:‏‏‏‏ فَلَمَّا مَاتَ أَخَذْنَا ذَلِكَ الْجَامَ فَبِعْنَاهُ بِأَلْفِ دِرْهَمٍ، ‏‏‏‏‏‏ثُمَّ اقْتَسَمْنَاهُ أَنَا وَعَدِيُّ بْنُ بَدَّاءٍ، ‏‏‏‏‏‏فَلَمَّا قَدِمْنَا إِلَى أَهْلِهِ دَفَعْنَا إِلَيْهِمْ مَا كَانَ مَعَنَا، ‏‏‏‏‏‏وَفَقَدُوا الْجَامَ فَسَأَلُونَا عَنْهُ، ‏‏‏‏‏‏فَقُلْنَا:‏‏‏‏ مَا تَرَكَ غَيْرَ هَذَا وَمَا دَفَعَ إِلَيْنَا غَيْرَهُ، ‏‏‏‏‏‏قَالَ تَمِيمٌ:‏‏‏‏ فَلَمَّا أَسْلَمْتُ بَعْدَ قُدُومِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْمَدِينَةَ تَأَثَّمْتُ مِنْ ذَلِكَ فَأَتَيْتُ أَهْلَهُ فَأَخْبَرْتُهُمُ الْخَبَرَ وَأَدَّيْتُ إِلَيْهِمْ خَمْسَ مِائَةِ دِرْهَمٍ وَأَخْبَرْتُهُمْ أَنَّ عِنْدَ صَاحِبِي مِثْلَهَا، ‏‏‏‏‏‏فَأَتَوْا بِهِ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَسَأَلَهُمُ الْبَيِّنَةَ، ‏‏‏‏‏‏فَلَمْ يَجِدُوا،‏‏‏‏فَأَمَرَهُمْ أَنْ يَسْتَحْلِفُوهُ بِمَا يُعْظَمُ بِهِ عَلَى أَهْلِ دِينِهِ فَحَلَفَ، ‏‏‏‏‏‏فَأَنْزَلَ اللَّهُ يَأَيُّهَا الَّذِينَ آمَنُوا شَهَادَةُ بَيْنِكُمْ إِذَا حَضَرَ أَحَدَكُمُ الْمَوْتُ إِلَى قَوْلِهِ أَوْ يَخَافُوا أَنْ تُرَدَّ أَيْمَانٌ بَعْدَ أَيْمَانِهِمْ سورة المائدة آية 106 ـ 108، ‏‏‏‏‏‏فَقَامَ عَمْرُو بْنُ الْعَاصِ وَرَجُلٌ آخَرُ فَحَلَفَا، ‏‏‏‏‏‏فَنُزِعَتِ الْخَمْسُ مِائَةِ دِرْهَمٍ مِنْ عَدِيِّ بْنِ بَدَّاءٍ ، ‏‏‏‏‏‏قَالَ أَبُو عِيسَى:‏‏‏‏ هَذَا حَدِيثٌ غَرِيبٌ، ‏‏‏‏‏‏وَلَيْسَ إِسْنَادُهُ بِصَحِيحٍ، ‏‏‏‏‏‏وَأَبُو النَّضْرِ الَّذِي رَوَى عَنْهُ مُحَمَّدُ بْنُ إِسْحَاق هَذَا الْحَدِيثَ هُوَ عِنْدِي مُحَمَّدُ بْنُ السَّائِبِ الْكَلْبِيُّ، ‏‏‏‏‏‏يُكْنَى أَبَا النَّضْرِ، ‏‏‏‏‏‏وَقَدْ تَرَكَهُ أَهْلُ الْعِلْمِ بِالْحَدِيثِ وَهُوَ صَاحِبُ التَّفْسِيرِ، ‏‏‏‏‏‏سَمِعْت مُحَمَّدَ بْنَ إِسْمَاعِيل، ‏‏‏‏‏‏يَقُولُ:‏‏‏‏ مُحَمَّدُ بْنُ السَّائِبِ الْكَلْبِيُّ يُكْنَى أَبَا النَّضْرِ، ‏‏‏‏‏‏قَالَ أَبُو عِيسَى:‏‏‏‏ وَلَا نَعْرِفُ لِسَالِمٍ أَبِي النَّضْرِ الْمَدَنِيِّ رِوَايَةً عَنْ أَبِي صَالِحٍ مَوْلَى أُمِّ هَانِئٍ وَقَدْ رُوِيَ عَنْ ابْنِ عَبَّاسٍ شَيْءٌ مِنْ هَذَا عَلَى الِاخْتِصَارِ مِنْ غَيْرِ هَذَا الْوَجْهِ.

تمیم داری رضی الله عنہ سے روایت ہے، وہ اس آیت «يا أيها الذين آمنوا شهادة بينكم إذا حضر أحدكم الموت» ۱؎ کے سلسلے میں کہتے ہیں: میرے اور عدی بن بداء کے سواء سبھی لوگ اس آیت کی زد میں آنے سے محفوظ ہیں، ہم دونوں نصرانی تھے، اسلام سے پہلے شام آتے جاتے تھے تو ہم دونوں اپنی تجارت کی غرض سے شام گئے، ہمارے پاس بنی ہاشم کا ایک غلام بھی پہنچا، اسے بدیل بن ابی مریم کہا جاتا تھا، وہ بھی تجارت کی غرض سے آیا تھا، اس کے پاس چاندی کا ایک پیالہ تھا جسے وہ بادشاہ کے ہاتھ بیچ کر اچھے پیسے حاصل کرنا چاہتا تھا، یہی اس کی تجارت کے سامان میں سب سے بڑی چیز تھی۔ ( اتفاق ایسا ہوا کہ ) وہ بیمار پڑ گیا، تو اس نے ہم دونوں کو وصیت کی اور ہم سے عرض کیا کہ وہ جو کچھ چھوڑ کر مرے وہ اسے اس کے گھر والوں کو پہنچا دیں۔ جب وہ مر گیا تو ہم نے یہ پیالہ لے لیا اور ہزار درہم میں اسے بیچ دیا، پھر ہم نے اور عدی بن بداء نے اسے آپس میں تقسیم کر لیا، پھر ہم اس کے بیوی بچوں کے پاس آئے اور جو کچھ ہمارے پاس تھا وہ ہم نے انہیں واپس دے دیا، جب انہیں چاندی کا جام نہ ملا تو انہوں نے ہم سے اس کے متعلق پوچھا، ہم نے کہا کہ جو ہم نے آپ کو لا کر دیا اس کے سوا اس نے ہمارے پاس کچھ نہ چھوڑا تھا، پھر جب رسول اللہ صلی اللہ علیہ وسلم کے مدینہ جانے کے بعد میں نے اسلام قبول کر لیا، تو میں اس گناہ سے ڈر گیا، چنانچہ میں اس کے گھر والوں کے پاس آیا اور پیالہ کی صحیح خبر انہیں دے دی، اور اپنے حصہ کے پانچ سو درہم انہیں ادا کر دئیے، اور انہیں یہ بھی بتایا کہ میری طرح ( عدی بن بداء ) کے پاس بھی پیالہ کی قیمت کے پانچ سو درہم ہیں پھر وہ لوگ اسے رسول اللہ صلی اللہ علیہ وسلم کے پاس پکڑ کر لائے، آپ نے ان سے ثبوت مانگا تو وہ لوگ کوئی ثبوت پیش نہ کر سکے۔ پھر آپ نے ان لوگوں کو حکم دیا کہ وہ اس سے اس چیز کی قسم لیں جسے اس کے اہل دین اہم اور عظیم تر سمجھتے ہوں تو اس نے قسم کھا لی۔ اس پر آیت «يا أيها الذين آمنوا شهادة بينكم إذا حضر أحدكم الموت» سے لے کر «أو يخافوا أن ترد أيمان بعد أيمانهم» ۲؎ تک نازل ہوئی۔ تو عمرو بن العاص رضی الله عنہ اور ( بدیل کے وارثوں میں سے ) ایک اور شخص کھڑے ہوئے اور انہوں نے قسم کھائی کہ عدی جھوٹا ہے، پھر اس سے پانچ سو درہم چھین لیے گئے۔ امام ترمذی کہتے ہیں: ۱- یہ حدیث غریب ہے، اور اس کی سند صحیح نہیں ہے، ۲- ابوالنضر جن سے محمد بن اسحاق نے یہ حدیث روایت کی ہے، وہ میرے نزدیک محمد بن سائب کلبی ہیں، ابوالنضر ان کی کنیت ہے، محدثین نے ان سے روایت کرنی چھوڑ دی ہے، وہ صاحب تفسیر ہیں ( یعنی مفسرین میں جو کلبی مشہور ہیں وہ یہی شخص ہیں ) میں نے محمد بن اسماعیل بخاری کو کہتے ہوئے سنا: محمد بن سائب کلبی کی کنیت ابوالنضر ہے، ۳- اور ہم سالم ابوالنضر مدینی کی کوئی روایت ام ہانی کے آزاد کردہ غلام صالح سے نہیں جانتے۔ اس حدیث کا کچھ حصہ مختصراً کسی اور سند سے ابن عباس رضی الله عنہما سے مروی ہے ( جو آگے آ رہا ہے ) ۔

Narrated Ibn 'Abbas: A man from Banu Sahm went out with Tamim Ad-Dari and 'Adi bin Badda. The Sahmi man died in a land in which there were no Muslims. When they arrived with what he left behind, they searched for a bowl made of silver which was inlaid with gold. The Messenger of Allah (ﷺ) had the two of them take an oath. Then they found the bowl in Makkah, and the person said: 'We purchased it from Tamim and 'Adi.' So two men among the relatives of the Sahmi man stood to take an oath by Allah that they (his family) had more right to it than them. He said: So it was about them that the following was revealed: O you who believe! (When death approaches any of you then) take the testimony (5:106).

Narrated 'Ammar bin Yasir: The Messenger of Allah (ﷺ) said: 'The Ma'idah was sent down from the Heavens with bread and meat. And they were commanded to not be deceitful with it and hide it for tomorrow. So they were deceitful with it and they hid it, so it was raised up in the morning. Then they were transformed into monkeys and pigs.'

Narrated Abu Hurairah: 'Eisa was taught his argument, Allah taught him regarding His saying: And when Allah will say: 'O 'Eisa, son of Mariam! Did you say unto men 'Worship me and my mother as two gods besides Allah?' Abu Hurairah narrated from the Messenger of Allah (ﷺ): So Allah taught him: 'Glory be to You! It was not for me to say what I had no right (to say) (5:116).' The entire Ayah.

So when (the following) was revealed: 'Or to cover you in confusion in party strife, and make you taste the violence of one another (6:65).' The Prophet (ﷺ) said: 'This is less burdensome' or 'This is easier.'
