Narrated Abu Hurairah: That the Messenger of Allah (ﷺ) said: If one of your slave girl commits illegal sexual intercourse, then whip her three times according to the Book of Allah, and if she does it again then sell her, even if it is for a rope made of hair.

حَدَّثَنَا أَبُو سَعِيدٍ الْأَشَجُّ، حَدَّثَنَا أَبُو خَالِدٍ الْأَحْمَرُ، حَدَّثَنَا الْأَعْمَشُ، عَنْ أَبِي صَالِحٍ، عَنْ أَبِي هُرَيْرَةَ، قَالَ:‏‏‏‏ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَلْيَجْلِدْهَا ثَلَاثًا بِكِتَابِ اللَّهِ،‏‏‏‏ فَإِنْ عَادَتْ فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعَرٍ . قَالَ:‏‏‏‏ وَفِي الْبَاب،‏‏‏‏ عَنْ عَلِيٍّ،‏‏‏‏ وَأَبِي هُرَيْرَةَ،‏‏‏‏ وَزَيْدِ بْنِ خَالِدٍ،‏‏‏‏ وَشِبْلٍ،‏‏‏‏ عَنْ عَبْدِ اللَّهِ بْنِ مَالِكٍ الْأَوْسِيِّ. قَالَ أَبُو عِيسَى:‏‏‏‏ حَدِيثُ أَبِي هُرَيْرَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ،‏‏‏‏ وَقَدْ رُوِيَ عَنْهُ مِنْ غَيْرِ وَجْهٍ،‏‏‏‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ،‏‏‏‏ وَغَيْرِهِمْ رَأَوْا أَنْ يُقِيمَ الرَّجُلُ الْحَدَّ عَلَى مَمْلُوكِهِ دُونَ السُّلْطَانِ،‏‏‏‏ وَهُوَ قَوْلُ:‏‏‏‏ أَحْمَدَ،‏‏‏‏ وَإِسْحَاق،‏‏‏‏ قَالَ بَعْضُهُمْ:‏‏‏‏ يُرْفَعُ إِلَى السُّلْطَانِ،‏‏‏‏ وَلَا يُقِيمُ الْحَدَّ هُوَ بِنَفْسِهِ،‏‏‏‏ وَالْقَوْلُ الْأَوَّلُ أَصَحُّ.

ابوہریرہ رضی الله عنہ کہتے ہیں کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”جب تم میں سے کسی کی لونڈی زنا کرے تو اللہ کی کتاب کے ( حکم کے ) مطابق تین بار اسے کوڑے لگاؤ ۱؎ اگر وہ پھر بھی ( یعنی چوتھی بار ) زنا کرے تو اسے فروخت کر دو، چاہے قیمت میں بال کی رسی ہی ملے“۔ امام ترمذی کہتے ہیں: ۱- ابوہریرہ رضی الله عنہ کی حدیث حسن صحیح ہے، ۲- ان سے یہ حدیث کئی سندوں سے آئی ہے، ۳- اس باب میں علی، ابوہریرہ، زید بن خالد رضی الله عنہم سے اور شبل سے بواسطہ عبداللہ بن مالک اوسی بھی احادیث آئی ہیں، ۴- صحابہ میں سے بعض اہل علم اور کچھ دوسرے لوگوں کا اسی پر عمل ہے، یہ لوگ کہتے ہیں کہ سلطان ( حاکم ) کے بجائے آدمی اپنے مملوک ( غلام ) پر خود حد نافذ کرے، احمد اور اسحاق بن راہویہ کا یہی قول ہے، ۵- بعض لوگ کہتے ہیں: سلطان ( حاکم ) کے پاس مقدمہ پیش کیا جائے گا، کوئی آدمی بذات خود حد نافذ نہیں کرے گا، لیکن پہلا قول زیادہ صحیح ہے ۲؎۔

Narrated Abu 'Abdur-Rahman As-Sulami: Ali gave a Khutbah, and said: 'O people, establish the penalties upon your slaves, those married from them and those unmarried. A slave girl of the Prophet (ﷺ) committed illegal sexual intercourse so he ordered me to whip her. I went to her and she was just experiencing her post-natal bleeding, so I feared that if I were to whip her I would kill her' - or he said: 'She would die' - 'so I went to the Messenger of Allah (ﷺ) and I told that to him. So he said: 'You did well.'

Narrated Abu Sa'eed Al-Khudri: That the Messenger of Allah (ﷺ) implemented the penalty by beating forty times, with two shoes - Mis'ar (one of the narrators) said: It think it was for wine.

Narrated Anas: That a man who had drunk wine was brought to the Prophet (ﷺ), so he beat him about forty times with two stalks of a palm tree. So Abu Bakr did similarly, and by the time 'Umar became Khalifah he sought council from the people. And 'Abdur-Rahman bin 'Awf said: 'I see that the lightest penalty is eighty lashes,' so 'Umar ordered that.
