Narrated Ibn 'Umar: That the Messenger of Allah (ﷺ) lashed and banished, Abu Bakr lashed and banished, and 'Umar lashed and banished.

حَدَّثَنَا أَبُو كُرَيْبٍ، وَيَحْيَى بْنُ أَكْثَمَ، قَالَا:‏‏‏‏ حَدَّثَنَا عَبْدُ اللَّهِ بْنُ إِدْرِيسَ،‏‏‏‏ عَنْ عُبَيْدِ اللَّهِ،‏‏‏‏ عَنْ نَافِعٍ،‏‏‏‏ عَنْ ابْنِ عُمَرَ،‏‏‏‏ أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ضَرَبَ،‏‏‏‏ وَغَرَّبَ ،‏‏‏‏ وَأَنَّ أَبَا بَكْرٍ:‏‏‏‏ ضَرَبَ وَغَرَّبَ،‏‏‏‏ وَأَنَّ عُمَرَ:‏‏‏‏ ضَرَبَ وَغَرَّبَ. قَالَ:‏‏‏‏ وَفِي الْبَاب،‏‏‏‏ عَنْ أَبِي هُرَيْرَةَ،‏‏‏‏ وَزَيْدِ بْنِ خَالِدٍ،‏‏‏‏ وَعُبَادَةَ بْنِ الصَّامِتِ،‏‏‏‏ قَالَ أَبُو عِيسَى:‏‏‏‏ حَدِيثُ ابْنِ عُمَرَ حَدِيثٌ غَرِيبٌ. رَوَاهُ غَيْرُ وَاحِدٍ،‏‏‏‏ عَنْ عَبْدِ اللَّهِ بْنِ إِدْرِيسَ،‏‏‏‏ فَرَفَعُوهُ،‏‏‏‏ وَرَوَى بَعْضُهُمْ،‏‏‏‏ عَنْ عَبْدِ اللَّهِ بْنِ إِدْرِيسَ،‏‏‏‏ هَذَا الْحَدِيثَ،‏‏‏‏ عَنْ عُبَيْدِ اللَّهِ،‏‏‏‏ عَنْ نَافِعٍ،‏‏‏‏ عَنْ ابْنِ عُمَرَ،‏‏‏‏ أَنَّ أَبَا بَكْرٍ:‏‏‏‏ ضَرَبَ وَغَرَّبَ،‏‏‏‏ وَأَنَّ عُمَرَ:‏‏‏‏ ضَرَبَ وَغَرَّبَ. حَدَّثَنَا بِذَلِكَ أَبُو سَعِيدٍ الْأَشَجُّ،‏‏‏‏ حَدَّثَنَا عَبْدُ اللَّهِ بْنُ إِدْرِيسَ. وَهَكَذَا رُوِيَ هَذَا الْحَدِيثُ مِنْ غَيْرِ رِوَايَةِ ابْنِ إِدْرِيسَ،‏‏‏‏ عَنْ عُبَيْدِ اللَّهِ بْنِ عُمَرَ نَحْوَ هَذَا،‏‏‏‏ وَهَكَذَا رَوَاهُ مُحَمَّدُ بْنُ إِسْحَاق،‏‏‏‏ عَنْ نَافِعٍ،‏‏‏‏ عَنْ ابْنِ عُمَرَ،‏‏‏‏ أَنَّ أَبَا بَكْرٍ:‏‏‏‏ ضَرَبَ وَغَرَّبَ،‏‏‏‏ وَأَنَّ عُمَرَ:‏‏‏‏ ضَرَبَ وَغَرَّبَ،‏‏‏‏ وَلَمْ يَذْكُرُوا فِيهِ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ،‏‏‏‏ وَقَدْ صَحَّ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ النَّفْيُ،‏‏‏‏ رَوَاهُ أَبُو هُرَيْرَةَ،‏‏‏‏ وَزَيْدُ بْنُ خَالِدٍ،‏‏‏‏ وعبادة بن الصامت،‏‏‏‏ وغيرهم،‏‏‏‏ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ،‏‏‏‏ مِنْهُمْ أَبُو بَكْرٍ،‏‏‏‏ وَعُمَرُ،‏‏‏‏ وَعَلِيٌّ،‏‏‏‏ وَأُبَيُّ بْنُ كَعْبٍ،‏‏‏‏ وَعَبْدُ اللَّهِ بْنُ مَسْعُودٍ،‏‏‏‏ وَأَبُو ذَرٍّ،‏‏‏‏ وَغَيْرُهُمْ،‏‏‏‏ وَكَذَلِكَ رُوِيَ عَنْ غَيْرِ وَاحِدٍ مِنْ فُقَهَاءِ التَّابِعِينَ،‏‏‏‏ وَهُوَ قَوْلُ:‏‏‏‏ سُفْيَانَ الثَّوْرِيِّ،‏‏‏‏ وَمَالِكِ بْنِ أَنَسٍ،‏‏‏‏ وَعَبْدِ اللَّهِ بْنِ الْمُبَارَكِ،‏‏‏‏ وَالشَّافِعِيِّ،‏‏‏‏ وَأَحْمَدَ،‏‏‏‏ وَإِسْحَاق.

عبداللہ بن عمر رضی الله عنہما سے روایت ہے کہ نبی اکرم صلی اللہ علیہ وسلم نے ( غیر شادی شدہ زانی اور زانیہ کو ) کوڑے لگائے اور شہر بدر کیا ابوبکر رضی الله عنہ نے بھی کوڑے لگائے اور شہر بدر کیا، اور عمر رضی الله عنہ نے بھی کوڑے لگائے اور شہر بدر کیا۔ امام ترمذی کہتے ہیں: ۱- ابن عمر رضی الله عنہما کی حدیث غریب ہے، ۲- اسے کئی لوگوں نے عبداللہ بن ادریس سے روایت کیا ہے، اور ان لوگوں نے اسے مرفوع کیا ہے، ( جب کہ ) بعض لوگوں نے اس حدیث کو بطریق: «عن عبد الله بن إدريس هذا الحديث عن عبيد الله عن نافع عن ابن عمر» ( موقوفاً ) روایت کیا ہے کہ ابوبکر رضی الله عنہ نے ( غیر شادی شدہ زانی کو ) کوڑے لگائے اور شہر بدر کیا، عمر رضی الله عنہ نے کوڑے لگائے اور شہر بدر کیا، ۳- اس باب میں ابوہریرہ، زید بن خالد اور عبادہ بن صامت رضی الله عنہ سے بھی احادیث آئی ہیں۔ ہم سے اسے ابوسعید اشج نے بیان کیا، وہ کہتے ہیں کہ ہم سے عبداللہ بن ادریس نے بیان کیا، نیز اسی طرح یہ حدیث عبداللہ بن ادریس کے علاوہ کئی ایک نے عبیداللہ بن عمر سے روایت کی ہے، اسی طرح اسے محمد بن اسحاق نے نافع سے، نافع نے ابن عمر رضی الله عنہما سے ( موقوفاً ) روایت کیا ہے کہ ابوبکر رضی الله عنہ نے کوڑے لگائے اور شہر بدر کیا، اور عمر رضی الله عنہ نے کوڑے لگائے اور شہر بدر کیا، لیکن اس میں ان لوگوں نے اس کا ذکر نہیں کیا کہ یہ حدیث نبی اکرم صلی اللہ علیہ وسلم سے آئی ہے، ۱- حالانکہ رسول اللہ صلی اللہ علیہ وسلم سے مروی شہر بدر کرنے کی روایت صحیح ہے، ۲- اسے ابوہریرہ، زید بن خالد اور عبادہ بن صامت وغیرہ رضی الله عنہم نے نبی اکرم صلی اللہ علیہ وسلم سے روایت کیا ہے، ۳- نبی اکرم صلی اللہ علیہ وسلم کے صحابہ میں سے بعض اہل علم کا عمل اسی پر ہے، ان لوگوں میں ابوبکر، عمر، علی، ابی بن کعب، عبداللہ بن مسعود اور ابوذر وغیرہم رضی الله عنہم شامل ہیں، اسی طرح یہ حدیث کئی تابعین فقہاء سے مروی ہے، سفیان ثوری مالک بن انس، عبداللہ بن مبارک، شافعی، احمد اور اسحاق بن راہویہ کا یہی قول ہے۔

Narrated 'Ubadah bin As-Samit: We were with the Prophet (ﷺ) [in a gathering] and he said: 'Pledge to me that you will not associate [anything as] partners with Allah, and that you will not steal nor commit adultery.' He recited to them the Ayah. (And he said:)'Whoever among you dies, then this reward is with Allah, and whoever among you does some of this and then he is punished, it is atonement for him. And whoever does some of this and Allah covers it for him, then it is up to Allah; if He wills, He will punish them, and if He wills, He will forgive him.'

Narrated Abu Hurairah: That the Messenger of Allah (ﷺ) said: If one of your slave girl commits illegal sexual intercourse, then whip her three times according to the Book of Allah, and if she does it again then sell her, even if it is for a rope made of hair.

Narrated Abu 'Abdur-Rahman As-Sulami: Ali gave a Khutbah, and said: 'O people, establish the penalties upon your slaves, those married from them and those unmarried. A slave girl of the Prophet (ﷺ) committed illegal sexual intercourse so he ordered me to whip her. I went to her and she was just experiencing her post-natal bleeding, so I feared that if I were to whip her I would kill her' - or he said: 'She would die' - 'so I went to the Messenger of Allah (ﷺ) and I told that to him. So he said: 'You did well.'

Narrated Abu Sa'eed Al-Khudri: That the Messenger of Allah (ﷺ) implemented the penalty by beating forty times, with two shoes - Mis'ar (one of the narrators) said: It think it was for wine.

Narrated Anas: That a man who had drunk wine was brought to the Prophet (ﷺ), so he beat him about forty times with two stalks of a palm tree. So Abu Bakr did similarly, and by the time 'Umar became Khalifah he sought council from the people. And 'Abdur-Rahman bin 'Awf said: 'I see that the lightest penalty is eighty lashes,' so 'Umar ordered that.
