Narrated Ibn 'Umar: The Prophet (ﷺ) made a deal with the people of Khaibar for half of what was produced from it, whether fruits or crops.

حَدَّثَنَا إِسْحَاق بْنُ مَنْصُورٍ،‏‏‏‏ أَخْبَرَنَا يَحْيَى بْنُ سَعِيدٍ،‏‏‏‏ عَنْ عُبَيْدِ اللَّهِ،‏‏‏‏ عَنْ نَافِعٍ،‏‏‏‏ عَنْ ابْنِ عُمَرَ،‏‏‏‏ أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَامَلَ أَهْلَ خَيْبَرَ بِشَطْرِ مَا يَخْرُجُ مِنْهَا مِنْ ثَمَرٍ أَوْ زَرْعٍ . قَالَ:‏‏‏‏ وَفِي الْبَاب،‏‏‏‏ عَنْ أَنَسٍ،‏‏‏‏ وَابْنِ عَبَّاسٍ،‏‏‏‏ وَزَيْدِ بْنِ ثَابِتٍ،‏‏‏‏ وَجَابِرٍ. قَالَ أَبُو عِيسَى:‏‏‏‏ هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ،‏‏‏‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ،‏‏‏‏ لَمْ يَرَوْا بِالْمُزَارَعَةِ بَأْسًا عَلَى النِّصْفِ وَالثُّلُثِ وَالرُّبُعِ،‏‏‏‏ وَاخْتَارَ بَعْضُهُمْ أَنْ يَكُونَ الْبَذْرُ مِنْ رَبِّ الْأَرْضِ،‏‏‏‏ وَهُوَ قَوْلُ:‏‏‏‏ أَحْمَدَ،‏‏‏‏ وَإِسْحَاق،‏‏‏‏ وَكَرِهَ بَعْضُ أَهْلِ الْعِلْمِ الْمُزَارَعَةَ بِالثُّلُثِ وَالرُّبُعِ،‏‏‏‏ وَلَمْ يَرَوْا بِمُسَاقَاةِ النَّخِيلِ بِالثُّلُثِ وَالرُّبُعِ بَأْسًا،‏‏‏‏ وَهُوَ قَوْلُ:‏‏‏‏ مَالِكِ بْنِ أَنَسٍ،‏‏‏‏ وَالشَّافِعِيِّ،‏‏‏‏ وَلَمْ يَرَ بَعْضُهُمْ أَنْ يَصِحَّ شَيْءٌ مِنَ الْمُزَارَعَةِ،‏‏‏‏ إِلَّا أَنْ يَسْتَأْجِرَ الْأَرْضَ بِالذَّهَبِ وَالْفِضَّةِ.

عبداللہ بن عمر رضی الله عنہما کہتے ہیں کہ نبی اکرم صلی اللہ علیہ وسلم نے خیبر والوں کے ساتھ خیبر کی زمین سے جو بھی پھل یا غلہ حاصل ہو گا اس کے آدھے پر معاملہ کیا ۱؎۔ امام ترمذی کہتے ہیں: ۱- یہ حدیث حسن صحیح ہے، ۲- اس باب میں انس، ابن عباس، زید بن ثابت اور جابر رضی الله عنہم سے بھی احادیث آئی ہیں، ۳- صحابہ کرام وغیرہم میں سے بعض اہل علم کا اسی پر عمل ہے۔ یہ لوگ آدھے، تہائی یا چوتھائی کی شرط پر مزارعت کرنے میں کوئی حرج نہیں سمجھتے، ۴- اور بعض اہل علم نے یہ اختیار کیا ہے کہ بیج زمین والا دے گا، احمد اور اسحاق بن راہویہ کا بھی یہی قول ہے، ۵- بعض اہل علم نے تہائی یا چوتھائی کی شرط پر مزارعت کو مکروہ سمجھا ہے، لیکن وہ تہائی یا چوتھائی کی شرط پر کھجور کے درختوں کی سینچائی کرانے میں کوئی حرج نہیں سمجھتے ہیں۔ مالک بن انس اور شافعی کا یہی قول ہے، ۶- بعض لوگ مطلقًا مزارعت کو درست نہیں سمجھتے البتہ سونے یا چاندی ( نقدی ) کے عوض کرایہ پر زمین لینے کو درست سمجھتے ہیں۔

Narrated Rafi' bin Khadij: The Messenger of Allah (ﷺ) forbade us from a matter that was of benefit for us. When one of us had some land and we would let someone use it for a portion of its produce or some Dirham. He said: 'When one of you has some land then let him grant it to his brother, or let him farm it.'

Narrated Ibn 'Abbas: The Messenger of Allah (ﷺ) did not prohibit share-cropping. But he ordered that they be helpful with each other.

Narrated Ibn Mas'ud: The Messenger of Allah (ﷺ) judged for the accidental blood-Money: Twenty Bint Makhad, twenty make Ibn Makhad, twenty Bint Labunm twenty Jadha'ah, and twenty Hiqqah. (Another chain) with similar meaning.

Narrated Amr bin Shu'aib: from his father, from his grandfather that the Prophet (ﷺ) said: Whoever kills [a believer] deliberately, he is handed over to the guardians of the one killed. If they wish to, they have him killed, and if they wish to, they take the blood-money. That is thirty Hiqqah, thirty Jadha'ahs and forty pregnant camels. Whatever (amount more) they require from him, than that is for them (if they choose). THat is because of the severity of blood-money.

Narrated 'Ikrimah: from Ibn 'Abbas that the Prophet (ﷺ) made the blood-money twelve thousand.

(Another chain) from 'Ikrimah from the Prophet (ﷺ) and it is similar but he did not mention from Ibn 'Abbas in it. There is much more criticism than this for (this) narration of Ibn 'Uyainah.
