Abu Hurairah narrated: The Messenger of Allah (ﷺ) passed judgement based on an oath along with one witness. Rabi'ah (one of the narrators) said: A son of Ibn Sa'd bin 'Ubadah informed me saying: 'We found in a book of Sa'd that the Prophet (ﷺ) passed judgement based on an oath along with a witness.'

حَدَّثَنَا يَعْقُوبُ بْنُ إِبْرَاهِيمَ الدَّوْرَقِيُّ،‏‏‏‏ حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ،‏‏‏‏ قَالَ:‏‏‏‏ حَدَّثَنِي رَبِيعَةُ بْنُ أَبِي عَبْدِ الرَّحْمَنِ،‏‏‏‏ عَنْ سُهَيْلِ بْنِ أَبِي صَالِحٍ،‏‏‏‏ عَنْ أَبِيهِ،‏‏‏‏ عَنْ أَبِي هُرَيْرَةَ، قَالَ:‏‏‏‏ قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِالْيَمِينِ مَعَ الشَّاهِدِ الْوَاحِدِ . قَالَ رَبِيعَةُ:‏‏‏‏ وَأَخْبَرَنِي ابْنٌ لِسَعْدِ بْنِ عُبَادَةَ،‏‏‏‏ قَالَ:‏‏‏‏ وَجْدنَا فِي كِتَاب سَعْدٍ،‏‏‏‏ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ،‏‏‏‏ قَضَى بِالْيَمِينِ مَعَ الشَّاهِدِ. قَالَ:‏‏‏‏ وَفِي الْبَاب،‏‏‏‏ عَنْ عَلِيٍّ،‏‏‏‏ وَجَابِرٍ،‏‏‏‏ وَابْنِ عَبَّاسٍ،‏‏‏‏ وَسُرَّقَ. قَالَ أَبُو عِيسَى:‏‏‏‏ حَدِيثُ أَبِي هُرَيْرَةَ،‏‏‏‏ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى بِالْيَمِينِ مَعَ الشَّاهِدِ الْوَاحِدِ . حَدِيثٌ حَسَنٌ غَرِيبٌ.

ابوہریرہ رضی الله عنہ کہتے ہیں کہ رسول اللہ صلی اللہ علیہ وسلم نے ایک گواہ کے ساتھ مدعی کی قسم سے ( مدعی کے حق میں ) فیصلہ دیا۔ ربیعہ کہتے ہیں: مجھے سعد بن عبادہ کے بیٹے نے خبر دی کہ ہم نے سعد رضی الله عنہ کی کتاب میں لکھا پایا کہ نبی اکرم صلی اللہ علیہ وسلم نے ”ایک گواہ اور مدعی کی قسم سے ( مدعی کے حق میں ) فیصلہ دیا“ ۱؎۔ امام ترمذی کہتے ہیں: ۱- اس باب میں علی، جابر، ابن عباس اور سرق رضی الله عنہم سے بھی احادیث آئی ہیں، ۲- ابوہریرہ رضی الله عنہ کی حدیث کہ ”نبی اکرم صلی اللہ علیہ وسلم نے ایک گواہ اور مدعی کی قسم سے ( مدعی کے حق میں ) فیصلہ کیا“ حسن غریب ہے۔

Ja'far bin Muhammad narrated from his father: The Prophet (ﷺ) passed judgement based on an oath along with one witness. He said: And 'Ali judged between you based on it.

Ibn 'Umar narrated that the Prophet (ﷺ) said: Whoever frees a portion or, he said: a part or he said: a share he owns of a slave, then he can afford the remainder of the price according to the reasonable price, then he will be free. Otherwise he has freed as much as he has freed (only). Ayyub (one of the narrators) said: Perhaps Nafi said in this Hadith: 'Meaning he has freed as much of him as he has freed.'

Salim narrated from his father that the Prophet (ﷺ) said: Whoever frees a portion of a slave he owns, then he can afford the remainder of the price, then he should free him with his wealth.
