Narrated Abu Huraira: Allah's Apostle gave the judgment that a male or female slave should be given in Qisas for an abortion case of a woman from the tribe of Bani Lihyan (as blood money for the fetus) but the lady on whom the penalty had been imposed died, so the Prophets ordered that her property be inherited by her offspring and her husband and that the penalty be paid by her Asaba.
حَدَّثَنَا قُتَيْبَةُ ، حَدَّثَنَا اللَّيْثُ ، عَنْ ابْنِ شِهَابٍ ، عَنْ ابْنِ الْمُسَيَّبِ ، عَنْ أَبِي هُرَيْرَةَ ، أَنَّهُ قَالَ : قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي جَنِينِ امْرَأَةٍ مِنْ بَنِي لَحْيَانَ سَقَطَ مَيِّتًا ، بِغُرَّةٍ عَبْدٍ أَوْ أَمَةٍ ، ثُمَّ إِنَّ الْمَرْأَةَ الَّتِي قَضَى لَهَا بِالْغُرَّةِ تُوُفِّيَتْ ، فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِأَنَّ مِيرَاثَهَا لِبَنِيهَا ، وَزَوْجِهَا ، وَأَنَّ الْعَقْلَ عَلَى عَصَبَتِهَا .
ہم سے قتیبہ بن سعید نے بیان کیا، کہا ہم سے لیث نے، ان سے ابن شہاب نے، ان سے ابن المسیب نے اور ان سے ابوہریرہ رضی اللہ عنہ نے بیان کیا کہ   رسول اللہ صلی اللہ علیہ وسلم نے بنی لحیان کی ایک عورت ملیا بنت عویمر کے بچے کے بارے میں جو ایک عورت کی مار سے مردہ پیدا ہوا تھا کہ مارنے والی عورت کو خون بہا کے طور پر ایک غلام یا لونڈی ادا کرنے کا حکم فرمایا تھا۔ پھر وہ عورت بچہ گرانے والی جس کے متعلق نبی کریم صلی اللہ علیہ وسلم نے فیصلہ دیا تھا مر گئی تو نبی کریم صلی اللہ علیہ وسلم نے فیصلہ کیا کہ اس کی میراث اس کے لڑکوں اور شوہر کو دے دی جائے اور یہ دیت ادا کرنے کا حکم اس کے کنبہ والوں کو دیا تھا۔

Narrated Al-Aswad: Mu`adh bin Jabal gave this verdict for us in the lifetime of Allah's Apostle. One-half of the inheritance is to be given to the daughter and the other half to the sister. Sulaiman said: Mu`adh gave a verdict for us, but he did not mention that it was so in the lifetime of Allah's Apostle.

Narrated Abu Huraira: Allah's Apostle said, I am more closer to the believers than their ownselves, so whoever (among them) dies leaving some inheritance, his inheritance will be given to his 'Asaba, and whoever dies leaving a debt or dependants or destitute children, then I am their supporter.
