Narrated Mujahid: (regarding the Verse): 'If any of you dies and leaves wives behind,' That was the period of the 'Iddah which the widow was obliged to spend in the house of the late husband. Then Allah revealed: And those of you who die and leave wives should bequeath for their wives a year's maintenance and residence without turning them out, but if they leave, there is no blame on you for what they do of themselves, provided it is honorable (i.e. lawful marriage) (2.240) Mujahid said: Allah has ordered that a widow has the right to stay for seven months and twenty days with her husband's relatives through her husband's will and testament so that she will complete the period of one year (of 'Iddah). But the widow has the right to stay that extra period or go out of her husband's house as is indicated by the statement of Allah: 'But if they leave there is no blame on you,... ' (2.240) Ibn `Abbas said: The above Verse has cancelled the order of spending the period of the 'Iddah at her late husband's house, and so she could spend her period of the 'Iddah wherever she likes. And Allah says: 'Without turning them out.' 'Ata said: If she would, she could spend her period of the 'Iddah at her husband's house, and live there according to her (husband's) will and testament, and if she would, she could go out (of her husband's house) as Allah says: 'There is no blame on you for what they do of themselves.' (2.240) 'Ata added: Then the Verses of inheritance were revealed and the order of residence (for the widow) was cancelled, and she could spend her period of the 'Iddah wherever she would like, and she was no longer entitled to be accommodated by her husband's family.

حَدَّثَنِي إِسْحَاقُ بْنُ مَنْصُورٍ ، أَخْبَرَنَا رَوْحُ بْنُ عُبَادَةَ ، حَدَّثَنَا شِبْلٌ ، عَنْ ابْنِ أَبِي نَجِيحٍ ، عَنْ مُجَاهِدٍ وَالَّذِينَ يُتَوَفَّوْنَ مِنْكُمْ وَيَذَرُونَ أَزْوَاجًا سورة البقرة آية 234 ، قَالَ : كَانَتْ هَذِهِ الْعِدَّةُ تَعْتَدُّ عِنْدَ أَهْلِ زَوْجِهَا وَاجِبًا ، فَأَنْزَلَ اللَّهُ وَالَّذِينَ يُتَوَفَّوْنَ مِنْكُمْ وَيَذَرُونَ أَزْوَاجًا وَصِيَّةً لأَزْوَاجِهِمْ مَتَاعًا إِلَى الْحَوْلِ غَيْرَ إِخْرَاجٍ فَإِنْ خَرَجْنَ فَلا جُنَاحَ عَلَيْكُمْ فِي مَا فَعَلْنَ فِي أَنْفُسِهِنَّ مِنْ مَعْرُوفٍ سورة البقرة آية 240 ، قَالَ : جَعَلَ اللَّهُ لَهَا تَمَامَ السَّنَةِ سَبْعَةَ أَشْهُرٍ وَعِشْرِينَ لَيْلَةً وَصِيَّةً ، إِنْ شَاءَتْ سَكَنَتْ فِي وَصِيَّتِهَا وَإِنْ شَاءَتْ خَرَجَتْ ، وَهُوَ قَوْلُ اللَّهِ تَعَالَى : غَيْرَ إِخْرَاجٍ فَإِنْ خَرَجْنَ فَلا جُنَاحَ عَلَيْكُمْ سورة البقرة آية 240 ، فَالْعِدَّةُ كَمَا هِيَ وَاجِبٌ عَلَيْهَا زَعَمَ ذَلِكَ ، عَنْ مُجَاهِدٍ ، وَقَالَ عَطَاءٌ : قَالَ ابْنُ عَبَّاسٍ : نَسَخَتْ هَذِهِ الْآيَةُ عِدَّتَهَا عِنْدَ أَهْلِهَا ، فَتَعْتَدُّ حَيْثُ شَاءَتْ ، وَقَوْلُ اللَّهِ تَعَالَى : غَيْرَ إِخْرَاجٍ سورة البقرة آية 240 ، وَقَالَ عَطَاءٌ : إِنْ شَاءَتِ اعْتَدَّتْ عِنْدَ أَهْلِهَا وَسَكَنَتْ فِي وَصِيَّتِهَا ، وَإِنْ شَاءَتْ خَرَجَتْ لِقَوْلِ اللَّهِ : فَلا جُنَاحَ عَلَيْكُمْ فِيمَا فَعَلْنَ فِي أَنْفُسِهِنَّ سورة البقرة آية 234 ، قَالَ عَطَاءٌ : ثُمَّ جَاءَ الْمِيرَاثُ ، فَنَسَخَ السُّكْنَى ، فَتَعْتَدُّ حَيْثُ شَاءَتْ وَلَا سُكْنَى لَهَا .

مجھ سے اسحاق بن منصور نے بیان کیا، کہا ہم کو روح بن عبادہ نے خبر دی، کہا ہم سے شبل بن عباد نے، ان سے ابن ابی نجیح نے اور ان سے مجاہد نے آیت کریمہ «والذين يتوفون منكم ويذرون أزواجا‏» الخ، یعنی ”اور جو لوگ تم میں سے وفات پا جائیں اور بیویاں چھوڑ جائیں۔“ کے متعلق کہا کہ یہ عدت جو شوہر کے گھر والوں کے پاس گزاری جاتی تھی، پہلے واجب تھی، اس لیے اللہ تعالیٰ نے یہ آیت اتاری «والذين يتوفون منكم ويذرون أزواجا وصية لأزواجهم متاعا إلى الحول غير إخراج فإن خرجن فلا جناح عليكم فيما فعلن في أنفسهن من معروف‏» الخ، یعنی ”اور جو لوگ تم میں سے وفات پا جائیں اور بیویاں چھوڑ جائیں ( ان پر لازم ہے کہ ) اپنی بیویوں کے حق میں نفع اٹھانے کی وصیت کر جائیں کہ وہ ایک سال تک ( گھر سے ) نہ نکالی جائیں لیکن اگر وہ ( خود ) نکل جائیں تو کوئی گناہ تم پر نہیں۔“ اس باب میں جسے وہ ( بیویاں ) اپنے بارے میں دستور کے مطابق کریں۔ مجاہد نے کہا کہ اللہ تعالیٰ نے ایسی بیوہ کے لیے سات مہینے بیس دن سال بھر میں سے وصیت قرار دی۔ اگر وہ چاہے تو شوہر کی وصیت کے مطابق وہیں ٹھہری رہے اور اگر چاہے ( چار مہینے دس دن کی عدت ) پوری کر کے وہاں سے چلی جائے۔ اللہ تعالیٰ کے ارشاد «غير إخراج فإن خرجن فلا جناح عليكم‏» تک یعنی ”انہیں نکالا نہ جائے۔ البتہ اگر وہ خود چلی جائیں تو تم پر کوئی گناہ نہیں۔“ کا یہی منشا ہے۔ پس عدت تو جیسی کہ پہلے تھی، اب بھی اس پر واجب ہے۔ ابن ابی نجیح نے اسے مجاہد سے بیان کیا اور عطاء نے بیان کیا کہ ابن عباس رضی اللہ عنہما نے کہا کہ اس پہلی آیت نے بیوہ کو خاوند کے گھر میں عدت گزارنے کے حکم کو منسوخ کر دیا، اس لیے اب وہ جہاں چاہے عدت گزارے اور ( اسی طرح اس آیت نے ) اللہ تعالیٰ کے ارشاد «غير إخراج‏» یعنی ”انہیں نکالا نہ جائے۔“ ( کو بھی منسوخ کر دیا ہے ) ۔ عطاء نے کہا کہ اگر وہ چاہے تو اپنے ( شوہر کے ) گھر والوں کے یہاں ہی عدت گزارے اور وصیت کے مطابق قیام کرے اور اگر چاہے وہاں سے چلی آئے کیونکہ اللہ تعالیٰ نے فرمایا ہے «فلا جناح عليكم فيما فعلن‏» الخ، یعنی ”پس تم پر اس کا کوئی گناہ نہیں، جو وہ اپنی مرضی کے مطابق کریں۔“ عطاء نے کہا کہ اس کے بعد میراث کا حکم نازل ہوا اور اس نے مکان کے حکم کو منسوخ کر دیا۔ پس وہ جہاں چاہے عدت گزار سکتی ہے اور اس کے لیے ( شوہر کی طرف سے ) مکان کا انتظام نہیں ہو گا۔

Narrated Zainab bint Um Salama: When Um Habiba bint Abi Sufyan was informed of her father's death, she asked for perfume and rubbed it over her arms and said, I am not in need of perfume, but I have heard the Prophet saying, It is not lawful for a lady who believes in Allah and the Last Day to mourn for more than three days except for her husband for whom the (mourning) period is four months and ten days.

Narrated Abu Mas`ud: The Prophet prohibited taking the price of a dog, the earnings of a soothsayer and the money earned by prostitution.

Narrated Abu Juhaifa: The Prophet cursed the lady who practices tattooing and the one who gets herself tattooed, and one who eats (takes) Riba' (usury) and the one who gives it. And he prohibited taking the price of a dog, and the money earned by prostitution, and cursed the makers of pictures.

Narrated Sa`id bin Jubair: I said to Ibn `Umar, If a man accuses his wife of illegal sexual intercourse (what is the judgment)? He said, Allah's Prophet separated the couple of Bani 'Ajlan (when the husband accused his wife for an illegal sexual intercourse). The Prophet said, 'Allah knows that one of you two IS a liar; so will one of you repent?' But they refused. He then again said, 'Allah knows that one of you two is a liar; so will one of you repent?' But they refused, whereupon he separated them by divorce. Aiyub (a subnarrator) said: `Amr bin Dinar said to me, In the narration there is something which I do not see you mentioning, i.e. the husband said, What about my money (Mahr)?' The Prophet said, You are not entitled to take back money, for if you told the truth you have already entered upon her (and consummated your marriage with her) and if you are a liar then you are less entitled to take it back.

Narrated Ibn `Umar: The Prophet said to those who were involved in a case of Lian, Your accounts are with Allah. One of you two is a liar. You (husband) have right on her (wife). The husband said, My money, O Allah's Apostle! The Prophet said, You are not entitled to take back any money. If you have told the truth, the Mahr that you paid, was for having sexual relations with her lawfully; and if you are a liar, then you are less entitled to get it back.
