Narrated Ibn `Umar: `Umar expelled the Jews and the Christians from Hijaz. When Allah's Apostle had conquered Khaibar, he wanted to expel the Jews from it as its land became the property of Allah, His Apostle, and the Muslims. Allah's Apostle intended to expel the Jews but they requested him to let them stay there on the condition that they would do the labor and get half of the fruits. Allah's Apostle told them, We will let you stay on thus condition, as long as we wish. So, they (i.e. Jews) kept on living there until `Umar forced them to go towards Taima' and Ariha'.

حَدَّثَنَا أَحْمَدُ بْنُ الْمِقْدَامِ ، حَدَّثَنَا فُضَيْلُ بْنُ سُلَيْمَانَ ، حَدَّثَنَا مُوسَى ، أَخْبَرَنَا نَافِعٌ ، عَنِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا ، قَالَ : كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ . وَقَالَ عَبْدُ الرَّزَّاقِ : أَخْبَرَنَا ابْنُ جُرَيْجٍ ، قَالَ : حَدَّثَنِي مُوسَى بْنُ عُقْبَةَ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُمَا أَجْلَى الْيَهُودَ ، وَالنَّصَارَى مِنْ أَرْضِ الْحِجَازِ ، وَكَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَمَّا ظَهَرَ عَلَى خَيْبَرَ أَرَادَ إِخْرَاجَ الْيَهُودِ مِنْهَا ، وَكَانَتِ الْأَرْضُ حِينَ ظَهَرَ عَلَيْهَا لِلَّهِ وَلِرَسُولِهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَلِلْمُسْلِمِينَ ، وَأَرَادَ إِخْرَاجَ الْيَهُودِ مِنْهَا ، فَسَأَلَتْ الْيَهُودُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِيُقِرَّهُمْ بِهَا ، أَنْ يَكْفُوا عَمَلَهَا وَلَهُمْ نِصْفُ الثَّمَرِ ؟ فَقَالَ لَهُمْ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : نُقِرُّكُمْ بِهَا عَلَى ذَلِكَ مَا شِئْنَا ، فَقَرُّوا بِهَا حَتَّى أَجْلَاهُمْ عُمَرُ إِلَى تَيْمَاءَ ، وَأَرِيحَاءَ .

ہم سے احمد بن مقدام نے بیان کیا، انہوں نے کہا کہ ہم سے فضیل بن سلیمان نے بیان کیا، ان سے موسیٰ بن عقبہ نے بیان کیا کہ انہیں نافع نے خبر دی، اور ان سے عبداللہ بن عمر رضی اللہ عنہما نے بیان کیا کہ نبی کریم صلی اللہ علیہ وسلم نے ( جب خیبر پر ) فتح حاصل کی تھی ( دوسری سند ) اور عبدالرزاق نے کہا کہ ہم کو ابن جریج نے خبر دی، کہا کہ مجھ سے موسیٰ بن عقبہ نے بیان کیا، ان سے نافع نے، ان سے ابن عمر رضی اللہ عنہما نے کہ عمر بن خطاب رضی اللہ عنہ نے یہودیوں اور عیسائیوں کو سر زمین حجاز سے نکال دیا تھا اور جب نبی کریم صلی اللہ علیہ وسلم نے خیبر پر فتح پائی تو آپ نے بھی یہودیوں کو وہاں سے نکالنا چاہا تھا۔ جب آپ کو وہاں فتح حاصل ہوئی تو اس کی زمین اللہ اور اس کے رسول صلی اللہ علیہ وسلم اور مسلمانوں کی ہو گئی تھی۔ آپ کا ارادہ یہودیوں کو وہاں سے باہر کرنے کا تھا، لیکن یہودیوں نے رسول اللہ صلی اللہ علیہ وسلم سے درخواست کی کہ آپ ہمیں یہیں رہنے دیں۔ ہم ( خیبر کی اراضی کا ) سارا کام خود کریں گے اور اس کی پیداوار کا نصف حصہ لے لیں گے۔ اس پر رسول اللہ صلی اللہ علیہ وسلم نے فرمایا کہ اچھا جب تک ہم چاہیں تمہیں اس شرط پر یہاں رہنے دیں گے۔ چنانچہ وہ لوگ وہیں رہے اور پھر عمر رضی اللہ عنہ نے انہیں تیماء اور اریحاء کی طرف جلا وطن کر دیا۔

Narrated Rafi` bin Khadij: My uncle Zuhair said, Allah's Apostle forbade us to do a thing which was a source of help to us. I said, Whatever Allah's Apostle said was right. He said, Allah's Apostle sent for me and asked, 'What are you doing with your farms?' I replied, 'We give our farms on rent on the basis that we get the yield produced at the banks of the water streams (rivers) for the rent, or rent it for some Wasqs of barley and dates.' Allah's Apostle said, 'Do not do so, but cultivate (the land) yourselves or let it be cultivated by others gratis, or keep it uncultivated.' I said, 'We hear and obey.'

Narrated Jabir: The people used to rent their land for cultivation for one-third, one-fourth or half its yield. The Prophet said, Whoever has land should cultivate it himself or give it to his (Muslim) brother gratis; otherwise keep it uncultivated.

Narrated Abu Huraira: Allah's Apostle said, Whoever has land should cultivate it himself or give it to his (Muslim) brother gratis; otherwise he should keep it uncultivated.

Narrated `Amr: When I mentioned it (i.e. the narration of Rafi` 'bin Khadij: no. 532) to Tawus, he said, It is permissible to rent the land for cultivation, for Ibn `Abbas said, 'The Prophet did not forbid that, but said: One had better give the land to one's brother gratis rather than charge a certain amount for it.'

Narrated Nafi`: Ibn `Umar used to rent his farms in the time of Abu Bakr, `Umar, `Uthman, and in the early days of Muawiya.

Then he was told the narration of Rafi` 'bin Khadij that the Prophet had forbidden the renting of farms. Ibn `Umar went to Rafi` and I accompanied him. He asked Rafi` who replied that the Prophet had forbidden the renting of farms. Ibn `Umar said, You know that we used to rent our farms in the lifetime of Allah's Apostle for the yield of the banks of the water streams (rivers) and for certain amount of figs.
