Abudullah bin Mawhab - and some of them said- 'Abdullah bin Wahb, narrated from Tamim Ad-Dari who said: 'I asked the Messenger of Allah(S.A.W): What is the Sunnah regarding a man among the people of the Shirk who accepts Islam at the hand of a man among the Muslims?' So the Messenger of Allah(S.A.W) said: He is the closet of the people to him in his life and in his death.'
حَدَّثَنَا أَبُو كُرَيْبٍ، حَدَّثَنَا أَبُو أُسَامَةَ، وَابْنُ نُمَيْرٍ، ووكيع، عَنْ عَبْدِ الْعَزِيزِ بْنِ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ، عَنْ عَبْدِ اللَّهِ بْنِ مَوْهِبٍ، ‏‏‏‏‏‏وَقَالَ بَعْضُهُمْ:‏‏‏‏ عَنْ عَبْدِ اللَّهِ بْنِ وَهْبٍ، عَنْ تَمِيمٍ الدَّارِيِّ، قَالَ:‏‏‏‏ سَأَلْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَا السُّنَّةُ فِي الرَّجُلِ مِنْ أَهْلِ الشِّرْكِ يُسْلِمُ عَلَى يَدَيْ رَجُلٍ مِنَ الْمُسْلِمِينَ ؟ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ هُوَ أَوْلَى النَّاسِ بِمَحْيَاهُ وَمَمَاتِهِ ، ‏‏‏‏‏‏قَالَ أَبُو عِيسَى:‏‏‏‏ هَذَا حَدِيثٌ لَا نَعْرِفُهُ، ‏‏‏‏‏‏إِلَّا مِنْ حَدِيثِ عَبْدِ اللَّهِ بْنِ وَهْبٍ، ‏‏‏‏‏‏وَيُقَالُ:‏‏‏‏ ابْنُ مَوْهِبٍ، ‏‏‏‏‏‏عَنْ تَمِيمٍ الدَّارِيِّ، ‏‏‏‏‏‏وَقَدْ أَدْخَلَ بَعْضُهُمْ بَيْنَ عَبْدِ اللَّهِ بْنِ وَهْبٍ، ‏‏‏‏‏‏وَبَيْنَ تَمِيمٍ الدَّارِيِّ قَبِيصَةَ بْنَ ذُؤَيْبٍ وَلَا يَصِحُّ، ‏‏‏‏‏‏رَوَاهُ يَحْيَى بْنُ حَمْزَةَ، ‏‏‏‏‏‏عَنْ عَبْدِ الْعَزِيزِ بْنِ عُمَرَ، ‏‏‏‏‏‏وَزَادَ فِيهِ قَبِيصَةَ بْنَ ذُؤَيْبٍ وَهُوَ عِنْدِي لَيْسَ بِمُتَّصِلٍ، ‏‏‏‏‏‏وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ، ‏‏‏‏‏‏عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ، ‏‏‏‏‏‏وقَالَ بَعْضُهُمْ:‏‏‏‏ يُجْعَلُ مِيرَاثُهُ فِي بَيْتِ الْمَالِ، ‏‏‏‏‏‏وَهُوَ قَوْلُ الشَّافِعِيِّ، ‏‏‏‏‏‏وَاحْتَجَّ بِحَدِيثِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ .
تمیم داری رضی الله عنہ کہتے ہیں کہ   میں نے رسول اللہ صلی اللہ علیہ وسلم سے سوال کیا: اس مشرک کے بارے میں شریعت کا کیا حکم ہے جو کسی مسلمان کے ہاتھ پر اسلام لائے؟ آپ صلی اللہ علیہ وسلم نے فرمایا: ”وہ ( مسلمان ) اس ( نو مسلم ) کی زندگی اور موت کا میں تمام لوگوں سے زیادہ حقدار ہے۔ امام ترمذی کہتے ہیں: ۱- ہم اس حدیث کو صرف عبداللہ بن وہب کی روایت سے جانتے ہیں، ان کو ابن موہب بھی کہا جاتا ہے، یہ تمیم داری سے روایت کرتے ہیں۔ بعض لوگوں نے عبداللہ بن وہب اور تمیم داری کے درمیان قبیصہ بن ذویب کو داخل کیا ہے جو صحیح نہیں، یحییٰ بن حمزہ نے عبدالعزیز بن عمر سے یہ حدیث روایت کی ہے اور اس کی سند میں قبیصہ بن ذویب کا اضافہ کیا ہے، ۲- بعض اہل علم کا اسی حدیث پر عمل ہے، میرے نزدیک اس کی سند متصل نہیں ہے، ۳- بعض لوگوں نے کہا ہے: اس کی میراث بیت المال میں رکھی جائے گی، شافعی کا یہی قول ہے، انہوں نے نبی اکرم صلی اللہ علیہ وسلم کی ( اس ) حدیث سے استدلال کیا ہے «أن الولاء لمن أعتق» ”حق ولاء ( میراث ) اس شخص کو حاصل ہے جو آزاد کرے“۔

Amir bin Sa'd bin Abi Waqqas narrated from his father, who said: I was ill during the year of the Conquest (of Makkah) with an illness bringing me to the brink of death. So The Messenger of Allah (S.A.W) came to visit me, and I said: 'O Messenger of Allah (S.A.W)! Indeed I have a great deal of wealth and I do not have any heirs except my daughter, so should I will all of my wealth?' He said: 'No.' I said: 'Then two-thirds of my wealth?' He said: 'No.' I said: 'Then half?' He said: 'No.' I said: 'Then a third' He said: 'No.' A third and a third is too much. If you leave your heirs without need it is better than to leave them in poverty begging from the people. Indeed you do not do any spending (on your family) except that you are rewarded for it, even the morsel of food you raise to your wife's mouth.' He said: I said: 'Will I be left behind from my emigration?' He said: 'You will not be left behind after me,and do righteous deeds intending Allah's Face, except that it will add to your elevation in rank. Perhaps you will remain until some people benefit from you and others will be harmed by you. O Allah! Complete the emigration of my companions and do not turn them on their heels. But the case of Sa'd bin Khawlah is sad.' the Messenger of Allah (S.A.W) felt sorry for him dying in Makkah.

Abu Hurairah narrated that the Messenger of Allah (S.A.W) said: Indeed a man, and a woman, perform deeds in obedience to Allah for sixty years, then death presents itself to them, and they cause such harm in the will that the Fire becomes warranted for them. Then he recited: After payment of legacies he (or she) may have bequeathed or debts, without causing harm. This is a Commandment from Allah. up to His saying: That is the magnificent success.
