Abu Hurairah narrated that the Messenger of Allah (ﷺ) said: “The oath is based upon what will make your companion believe you.” [Qutaibah (one of the narrators) said: “ What will make you believed by your companion”]

حَدَّثَنَا قُتَيْبَةُ،‏‏‏‏ وَأَحْمَدُ بْنُ مَنِيعٍ الْمَعْنَى وَاحِدٌ،‏‏‏‏ قَالَا:‏‏‏‏ حَدَّثَنَا هُشَيْمٌ،‏‏‏‏ عَنْ عَبْدِ اللَّهِ بْنِ أَبِي صَالِحٍ،‏‏‏‏ عَنْ أَبِيهِ،‏‏‏‏ عَنْ أَبِي هُرَيْرَةَ، قَالَ:‏‏‏‏ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ الْيَمِينُ عَلَى مَا يُصَدِّقُكَ بِهِ صَاحِبُكَ ،‏‏‏‏ وقَالَ قُتَيْبَةُ:‏‏‏‏ عَلَى مَا صَدَّقَكَ عَلَيْهِ صَاحِبُكَ . قَالَ أَبُو عِيسَى:‏‏‏‏ هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ،‏‏‏‏ لَا نَعْرِفُهُ إِلَّا مِنْ حَدِيثِ هُشَيْمٍ،‏‏‏‏ عَنْ عَبْدِ اللَّهِ بْنِ أَبِي صَالِحٍ،‏‏‏‏ وَعَبْدُ اللَّهِ بْنُ أَبِي صَالِحٍ:‏‏‏‏ هُوَ أَخُو سُهَيْلِ بْنِ أَبِي صَالِحٍ،‏‏‏‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ،‏‏‏‏ وَبِهِ يَقُولُ أَحْمَدُ،‏‏‏‏ وَإِسْحَاق،‏‏‏‏ وَرُوِيَ عَنْ إِبْرَاهِيمَ النَّخَعِيِّ،‏‏‏‏ أَنَّهُ قَالَ:‏‏‏‏ إِذَا كَانَ الْمُسْتَحْلِفُ ظَالِمًا،‏‏‏‏ فَالنِّيَّةُ نِيَّةُ الْحَالِفِ،‏‏‏‏ وَإِذَا كَانَ الْمُسْتَحْلِفُ مَظْلُومًا،‏‏‏‏ فَالنِّيَّةُ نِيَّةُ الَّذِي اسْتَحْلَفَ.

ابوہریرہ رضی الله عنہ کہتے ہیں کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”قسم اسی چیز پر واقع ہو گی جس پر تمہارا ساتھی ( فریق مخالف ) قسم لے رہا ہے“ ( توریہ کا اعتبار نہیں ہو گا ) ۔ امام ترمذی کہتے ہیں: ۱- یہ حدیث حسن غریب ہے، ۲- ہم اسے ہشیم ہی کی روایت سے جانتے ہیں جسے انہوں نے عبداللہ بن ابی صالح سے روایت کی ہے۔ اور عبداللہ بن ابی صالح، سہیل بن ابی صالح کے بھائی ہیں، ۳- بعض اہل علم کا اسی پر عمل ہے، احمد اور اسحاق بن راہویہ بھی اسی کے قائل ہیں، ۴- ابراہیم نخعی کہتے ہیں کہ جب قسم لینے والا ظالم ہو تو قسم کھانے والے کی نیت کا اعتبار ہو گا، اور جب قسم لینے والا مظلوم ہو تو قسم لینے والے کی نیت کا اعتبار ہو گا۔

Abu Hurairah narrated that the Messenger of Allah (ﷺ) said: “Make the road seven forearm lengths.”
